THIS CONTEST IS SUBJECT TO ALL FEDERAL, PROVINCIAL, TERRITORIAL AND MUNICIPAL LAWS AND REGULATIONS. VOID WHERE PROHIBITED BY LAW.

 

  1. CONTEST PERIOD

 

The Shoppers Drug Mart/Pharmaprix Online 2019 Top Picks contest (the “Contest”) begins on September 7, 2019 at 12:00:00 a.m. Eastern Standard Time (“EST”) and closes October 4, 2019 at 11:59:59 p.m. EST (the “Contest Period”). By participating in this Contest, you agree and represent to the Contest Parties (defined below) that you have read and understand these Official Rules (the “Rules”), you meet the Contest eligibility requirements, you agree to be legally bound by the Rules, and that you agree to comply with, and abide by, the Rules and the decisions of the Sponsor (defined below) whose decisions shall be final.

 

  1. ELIGIBILITY

 

Contest is open only to residents of Canada who: (i) have reached the legal age of majority in their province/territory of residence at the time of entry; and (ii) are (or become) a registered PC Optimum member.  If you are not a PC Optimum member, registration is free. Employees, representatives or agents of Shoppers Drug Mart Inc/Pharmaprix Inc. (the “Sponsor”), the Contest administrator, IMC (“Administrator”), Shoppers Drug Mart and Pharmaprix stores, their respective owners, agents, representatives, parents, affiliates, subsidiaries, the prize suppliers and each of their respective advertising and promotional agencies (collectively, the “Contest Parties”) and their family members (a “family member” is defined as a parent, spouse, sibling or child) or those with whom they are domiciled ARE NOT ELIGIBLE to participate in the  Contest.

 

  1. HOW TO REGISTER

 

NO PURCHASE NECESSARY. To enter  the Contest, you must register first by visiting the Contest website, www.shopperdrugmart.ca/toppicks or www.pharmaprix.ca/toppicks (each, a “Contest Website”), during the Contest Period and follow the on-screen instructions to complete the registration process, which will require you to: (i) provide your first name, phone number, and email address; (ii) enter the unique Login PIN (referred to as a ‘Login Code’) which will be generated and emailed to you for the purposes of subsequent participation in the Contest; and, (iii) agree to be legally bound by the terms and conditions of these Rules. Once you have fully completed the registration process with all required information, click the 'Register' button to submit your registration (a “Registration”). To be eligible, your Registration must be fully completed and submitted during the Contest Period. You only need to register one (1) time to participate in this Contest.  One (1) Registration is permitted during the Contest Period for every valid PC Optimum account. 

STEPS:

  • Step 1: Go to shoppersdrugmart.ca/toppicks or pharmaprix.ca/toppicks
  • Step 2a: If you have already registered for the Contest, please login and start earning entries (see #4 below).
  • Step 2b: If you have not, please register using your PC Optimum email address
  • Step 2b(i): Once you have provided your email address, you will receive a unique Login PIN (via email) that must be used the first-time to sign into the Contest Sign in page. Once you have signed in for the first time, you can change the assigned PIN number.

 

 

  1. HOW TO EARN ENTRIES

Once you have completed the Registration process, log in to the Contest Website during the Contest Period to earn entries into the Contest (“Entries”).  The determination as to whether or not an entrant has successfully completed any of the foregoing requirements to obtain additional Entries shall be determined by the Sponsor at its sole discretion:

 

STEPS:

 

  • Step 1: In order to start earning entries, you need to log-in (see #3 above).
  • Step 2: Once completed, start voting for the 2019 Top Product Picks.
    • Each week (Saturday – Friday), starting September 7, 2019 and continuing for four (4) weeks thereafter, vote for your top products from Shoppers Drug Mart’s weekly curated list of 2019 Top Picks which will be divided into four different categories.
  • Step 3: With every one (1) vote you submit for each product category, you will receive 100 entries (weekly maximum of 400 entries for voting in all categories) that will be allocated towards the applicable weekly draw during which your associated votes were recorded as being completed (in accordance with Sponsor official records). Eligible entries from weekly draws, will automatically be carried over and applied to the next available weekly draw, where applicable.
  • Step 4: One (1) selected entrant’s name be will be drawn from all eligible entries received during the applicable weekly draw period (see #6 below)

 

 

You can vote and receive a maximum of four hundred (400) entries for each weekly draw entered (100 entries for each of the four product categories available for voting). A total of sixteen hundred (1,600) entries can be earned per entrant during the Contest Period.  

 

If it is discovered by the Sponsor (using any evidence or other information made available to or otherwise discovered by the Sponsor) that any person has attempted to: (i) use multiple names, identities, accounts, email addresses and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest; then he/she may be disqualified from the Contest (as determined by the Sponsor in its sole and absolute discretion).

 

All Prize entries, conversions, eligible transactions, registrations, Email Notifications, participating product NPN requests, product selections and any other type of information provided for the purposes of this Contest (collectively, “Contest-related Information”) and entrants are subject to verification at any time and for any reason.  The Sponsor reserve its right, in its sole and absolute discretion, to require proof of identity, eligibility and/or compliance with these Rules (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification): (i) for the purpose of verifying an individual’s eligibility to participate in this Contest; (ii) for the purpose of verifying the eligibility and/or compliance of any Contest-related Information submitted (or purportedly submitted) with these Rules; and/or (iii) for any other reason the Sponsor deems necessary, in its sole and absolute discretion, for the purpose of administering this Contest in accordance with these Rules.  Further, the Sponsor reserves its right to request an original Email Notification.  Failure to provide such proof to the satisfaction of the Sponsor within the timeline specified by the Sponsor (including, if required, providing the original Email Notification) may result in disqualification in the sole and absolute discretion of the Sponsor. The sole determinant of the time for the purposes of this Contest will be the Contest server machine(s). Disposable email addresses cannot be used for the purposes of this Contest. Sponsor is not responsible for any lost, late, incomplete, invalid, unintelligible or misdirected Contest-related Information, which will be disqualified. In the event of a dispute as to who has submitted any given Registration, the authorized account holder of the email address used to register will be deemed to be the registrant. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. An entrant may be required to show proof of being the applicable authorized account holder. All Contest-related Information becomes the sole and exclusive property of Sponsor and will not be returned. Entrants do not acquire any type of property rights (or any other type of rights) to Prize Entries. The Sponsor reserves the right to contact any registrant whose email address is submitted as part of this Contest for the purpose of administering this Contest.

 

  1.  THE PRIZES

 

WEEKLY PRIZES AND APPROXIMATE RETAIL VALUE

There are a total of four (4) prizes available to be won with one prize being awarded each week for a total of four (4) consecutive weeks (each, a “Prize”). Each Prize consists of 1 Million PC Optimum Points (ARV each: $1,000.00 Cdn.).

LIMIT OF ONE (1) PRIZE PER DECLARED WINNER.

The odds of winning a Prize depend upon the total number of eligible entries received during the weekly draw periods which will be cumulative over the Contest Period. 

Each Prize must be accepted as awarded and is not transferable, assignable or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions except at Sponsor’s option. The Sponsor reserves the right, in its sole and absolute discretion, to substitute any Prize with a prize of equal or greater value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. The characteristics and features of each Prize, except as explicitly stated above, are at the Sponsor’s sole and absolute discretion.

  1. RANDOM WEEKLY PRIZE DRAW, WINNER SELECTION AND WINNER ANNOUNCEMENT 

On or about September 18, September 25, October 2 and October 9, 2019 respectively (each a “Draw Dates”) in Toronto, Ontario at 9:00:00 am ET, the Sponsor will perform a random draw (the “Prize Draw”) from among all eligible entries received during the applicable weekly draw period to select one eligible entrant.  Eligible entries from weekly draws will automatically be carried over and applied to the next available weekly draw, where applicable.

 

 The Sponsor or its designated representative will make a maximum of two (2) attempts to contact each potential Prize winner via the email address provided at the time of registration within five (5) business days of the applicable Draw Date. If a potential Prize winner cannot be contacted within two (2) attempts or five (5) business days, whichever comes first, of the applicable Draw Date then such potential Prize winner will be disqualified (and will forfeit all rights to the applicable Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining applicable eligible Prize entries received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such new potential Prize winner, with the necessary amendments). 

 

BEFORE BEING DECLARED A CONFIRMED PRIZE WINNER, each potential Prize winner will be required to: (a) correctly answer a mathematical skill-testing question without mechanical or other aid which will be administered as determined by Sponsor; (b) sign and return within five (5) business days of notification the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the Prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, employees, agents, representatives, successors and assigns (collectively, the “ Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the applicable Prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor  in any manner whatsoever, including print, broadcast or the internet, and on the winners’ list. If a potential Prize winner: (a) fails to correctly answer the skill-testing question; (b) fails to return the properly executed Contest documents, within the specified time; and/or (c) cannot accept the applicable Prize as awarded (for any reason); then he/she will be disqualified (and will forfeit all rights to the applicable Prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining applicable eligible Prize Entries received in accordance with these Rules (in which case the foregoing provisions of this section shall apply to such new potential Prize winner, with the necessary amendments). 

AN ENTRANT IS NOT A WINNER OF ANY PRIZE, UNLESS AND UNTIL ENTRANT'S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. SPONSOR WILL NOT ACCEPT SCREENSHOTS OR OTHER EVIDENCE OF WINNING IN LIEU OF ITS VALIDATION PROCESS.

 

  1. GENERAL CONDITIONS

 

This Contest is subject to all applicable federal, provincial and municipal laws.  Void where prohibited by law. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of entrants or Contest-related Information.

 

The Releasees will not be liable for: (i) any failure of the Contest website during the Contest; (ii) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any Contest-related Information to be received for any reason including, but not limited to, technical problems, mail service problems, traffic congestion on the Internet or at any website; (iv) the failure of any customer to receive a contest entry email in relation to an Eligible Transaction; (v) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating or downloading any material in the Contest; and/or (vii) any combination of the above. 

 

Any entry email obtained through unauthorized or illegitimate sources or channels, including any entry email purchased or obtained online, will be void at the Sponsor’s sole discretion.  Any entry email which are not original, are illegible, have been tampered with, mutilated, altered, reproduced, stolen, forged or counterfeited, or any entry email which are irregular, or marked improperly will be void at the Sponsor’s sole discretion. 

 

The Sponsor reserves the right, subject only to the approval of the Régie des alcools, des courses et des jeux (the “Régie”) in Quebec, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules.  Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law.  The Sponsor, with the consent of the Régie, reserves the right to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason.

 

If due to printing, production, online, internet, computer or other error of any kind, more Prizes are claimed than intended to be awarded according to these Rules (at any prizing level), Sponsor reserves the right to conduct a random drawing from amongst all eligible Prize claimants whose claims have not yet been redeemed to award the correct number of Prizes at the applicable prizing level (as stated in these Rules). The Prizes may stop being awarded in the event Sponsor becomes aware of such an error.  In no event will the Sponsor be liable to award more than the number of Prizes (at the applicable prizing level), as provided in these Rules.   

  

The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, but subject to the approval of the Régie to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or any Contest-related Information with these Rules, or as a result of technical problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules.

 

For Quebec residents: Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling.  Any litigation respecting the awarding of a prize may be submitted to the board only for the purpose of helping the parties reach a settlement.

Subject only to the foregoing paragraph, all issues and questions concerning the construction, validity, interpretation and enforceability of these Rules or the rights and obligations of entrant and Sponsor in connection with the Contest shall be governed by and construed in accordance with the substantive laws of the Province of Ontario without regard to Ontario conflict of law principles, and all entrants consent to the jurisdiction and venue of the Province of Ontario.

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Registration (or otherwise in connection with participating in the Contest) for the purpose of administering the Contest and in accordance with the Shoppers Drug Mart Inc. Privacy Policy (http://corporate.shoppersdrugmart.ca/en-ca/privacy-policy.aspx). No commercial or other communications unrelated to the Contest will be sent to an entrant, unless such entrant has otherwise agreed to receive such communications.

In the event of any discrepancy or inconsistency between the terms and conditions of these English Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the French version of these Rules, and/or point of sale, television, print or online advertising; the terms and conditions of these English Rules shall prevail, govern and control.
